Terms of service

Who we are and what they cover

Tendfolio is a service of TooT S.r.l., registered office at Viale Della Resistenza 198, 87036 Rende (CS), Italy, VAT IT03518790781. These terms govern the use of the dashboard at tendfolio.com, the WordPress connector, the public API and related services. For personal data, the privacy policy applies and is part of these terms.

The service

Tendfolio lets you manage several WordPress sites from a single dashboard.

• You connect a site by installing the Tendfolio connector: from then on the dashboard can read the site’s status and run the operations you request — updates, backups, scans, content.
• We are not your hosting provider: sites stay where they are, and their availability also depends on the hosting, plugins and themes you choose.
• We work to keep the service always available, but we don’t guarantee a minimum uptime or the absence of interruptions, unless otherwise agreed in writing. We announce scheduled maintenance when possible.
• The service evolves: we may add, change or remove features. If we remove a feature included in a paid plan, we tell you beforehand.

Your account

• You must give us true information and keep it up to date, especially your email address: that’s where we send alerts about your sites.
• You are responsible for your credentials and those of the people you invite to your organisation, and for what they do in the dashboard with the permissions you assign.
• Only connect sites you have the right to administer: yours, or your clients’ who engaged you. If you manage clients’ sites, you are the controller of their data and we are the processor.
• An account is for one person; an organisation can have several members, depending on the plan.

Plans, free trial and payments

Plans, with their prices and limits, are those published on the pricing page at the time of subscription.

• The Free plan is free, with no card and no expiry, within the stated limits.
• Pro and Agency are monthly or yearly subscriptions, paid in advance and renewed automatically at the end of each period until you cancel.
• Prices are in euros and exclude VAT: VAT is added on the invoice based on the country and VAT number you enter at checkout.
• On your first subscription to a paid plan you get a 14-day free trial, once per organisation. A payment method is required to start it: the first charge happens at the end of the trial, unless you cancel before. We remind you a few days before it ends.
• Payments are handled by Stripe: card details never go through our systems. If a payment fails we may suspend paid features until it is settled.
• AI credit packs are paid once, don’t expire and are not refundable once used.
• If we change prices we tell you at least 30 days in advance: the new price applies from the next renewal, and you can cancel before it does.

Cancellation and refunds

• You can cancel at any time from Settings → Billing. The plan stays active until the end of the period already paid; then the organisation goes back to the Free plan.
• If you cancel during the free trial you pay nothing.
• We don’t refund periods already started or fractions of a period, except as required by law or for a billing error on our side.
• Back on Free, features not included stop being available: backups and data stay accessible within the Free plan’s limits and retention, so download what you need first.

If you are a consumer

Tendfolio is designed for professionals and businesses. If you use it as a consumer you have the rights the law grants you, including withdrawal within 14 days of subscribing: by asking to start the paid plan right away you accept that the service begins before that period ends, and if you withdraw you only pay for the part already used. To withdraw, write to [email protected].

Acceptable use

You may not use Tendfolio to:

• carry out illegal activities, or manage sites that spread illegal or malicious content;
• access sites or systems you have no right to administer;
• overload the service, probe it to bypass its protections or compromise it, including through the API beyond the stated limits;
• resell or hand over access to the service to third parties without our written agreement, outside what the agency plans provide;
• send unsolicited communications through the service’s features.

Your data and your sites

The content and data of your sites remain yours: we process them only to provide the service, as described in the privacy policy. Backups are an extra layer of protection, not a replacement for your own copies: keep an independent copy of whatever is irreplaceable to you. When the account is closed we delete data according to the timelines in the privacy policy.

Liability

Tendfolio runs on your sites the operations you request, including those proposed by the AI and confirmed by you. Updates, plugins and themes are third-party products: we are not liable for their defects nor for damage an update may cause, even when we start it at your request, while remaining committed to giving you the tools to prevent it and to restore. To the extent permitted by law, our total liability is limited to the amounts you paid us in the 12 months before the event, and excludes indirect damage such as loss of profit or customers. These limitations don’t apply in case of wilful misconduct or gross negligence, nor towards consumers beyond what the law allows.

Suspension and closure

• You can close your account at any time from Settings → Account.
• We may suspend or close an account that breaches these terms, endangers the service or other users, or doesn’t pay: where possible we warn you first and give you a chance to fix it.
• If one day we shut the service down, we would tell you at least 60 days in advance, refund the unused part of subscriptions and give you time to download your data.

Changes to these terms

We may update these terms. We notify you of material changes by email at least 30 days before they apply; if you don’t accept them you can cancel before, at no cost. The date at the top says when they were last updated.

Governing law and jurisdiction

These terms are governed by Italian law. For disputes with professionals and businesses the court of Cosenza has exclusive jurisdiction; for consumers the court of their place of residence remains competent. For any question write to [email protected].
